Sekiranya terdapat apa-apa kegagalan yang didapati mencemar peradaban adat dan akhlak yang membawa kesan kepada institusi ini, maka kami berhak mengugurkan apa jua anugerah yang telah diberikan atas budi bicara kami sebagai Duli Kepada Yang Maha Perkasa Lagi Penyayang.

THE POWERS, PREROGATIVES, AND SOVEREIGN AUTHORITY OF THE DATUK UNDANG OF NANING, IN THE STATE OF MELAKA
I. Of the
Sovereign Authority of Custom and Tradition Law
It is hereby declared that the Datuk Undang of Naning
is vested with the supreme authority of customary sovereignty within the
Territory of Naning, such authority being derived from the ancient and
immemorial system of Adat Perpatih, which existed long prior to the advent of
colonial administration and has continued, uninterrupted, to the present day.
The Datuk Undang stands not as a mere ceremonial dignitary but as a customary sovereign, exercising dominion over matters of
tradition, lineage, succession, honour, and the governance of customary
institutions. Such authority is inherent, original, and autonomous and is not
dependent upon, nor subordinate to, the executive organs of the modern state,
save where expressly limited by written law.
II. Of
Authority Recognised under the Constitution of the State of Melaka
The existence and authority of the Institution of the
Datuk Undang of Naning are duly acknowledged within the Constitution of the
State of Melaka, wherein Naning is recognised as a historic customary territory
possessing its own traditional governance.
The authority exercised by the Datuk Undang is distinct
from and independent of that exercised by the Yang di-Pertua Negeri of Melaka and shall not be construed as honorary or symbolic but rather as a form of customary
constitutional autonomy preserved by constitutional recognition and historical
continuity.
III. Of the
Royal Prerogative to Confer Orders, Honours, and Titles
The Datuk Undang of Naning enjoys the absolute and
unfettered prerogative to confer Orders of Merit, Medals of Distinction, and
Titles of Honour within the Naning institution.
Such prerogative includes the lawful bestowal of
titles such as Dato’, Dato’ Paduka, and Dato’ Sri, together with the
determination of their precedence, conditions, and proper usage. This power is
not derived by delegation from any state or federal authority but flows
directly from the sovereign character of the institution itself.
Any honour so conferred shall not be deemed contrary
to law nor in violation of national legislation, being protected by
constitutional principles recognising the continued existence of traditional
sovereign powers.
IV. Of the
Authority of the Datuk Undang as King of Naning
By reason of historical record, authoritative
documentation, and international acknowledgment, the Datuk Undang of Naning has
been recognised as the King of Naning.
Such recognition is evidenced in seventeenth-century
Dutch colonial records, in the annals of Istana Seri Menanti, and in classical
historical treatises concerning Melaka and Negeri Sembilan. In this sovereign
capacity, the Datuk Undang holds authority to preserve the dignity, autonomy,
and customary governance of Naning and to represent the territory in
traditional external relations according to established custom.
V. Of Customary
Judicial Authority
The Datuk Undang of Naning is the supreme judicial
authority in all matters arising under Adat Perpatih.
He is empowered to hear, interpret, and finally
determine disputes relating to customary law, including matters of inheritance,
succession, customary land, lineage, and traditional office. Decisions so
rendered possess binding moral and customary force and shall stand insofar as
they are not repugnant to written statute.
VI. Of the
Power to Appoint and Remove Customary Officers
The Datuk Undang of Naning retains the sole and
exclusive prerogative to appoint, suspend, or remove customary officers,
including but not limited to members of the Lembaga, Buapak, and other
recognised dignitaries of the customary hierarchy.
Such authority is exercised independently and requires
no ratification, approval, or endorsement from any political or administrative
body.
VII. Of the
Custodianship of Royal Lineage and Succession
The Datuk Undang of Naning is the lawful guardian and
arbiter of the royal genealogy and succession of Naning.
He alone is competent to determine the legitimacy of
royal descent, to recognise rightful heirs, and to reject any claim found to be
spurious, fraudulent, or unsupported by customary law, thereby safeguarding the
integrity and continuity of the royal institution.
VIII. Of
Constitutional Safeguards under the Federal Constitution
The powers and prerogatives of the Datuk Undang of
Naning are preserved and protected by the Federal Constitution, particularly:
Article 71(1),
which guarantees the right of Rulers and traditional authorities to hold,
enjoy, and exercise their constitutional powers in accordance with the
Constitution of their respective States; and
Article 181(1),
which affirms that the sovereignty, prerogatives, powers, and jurisdiction of
the Malay Rulers and traditional chiefs, as existing prior to independence,
shall remain inviolate and unaffected.
Accordingly, the authority of the Datuk Undang of
Naning is permanent in character and not subject to extinction by transient
political considerations.
IX. Of Moral
Authority and the Dignity of Sovereignty
Beyond legal and customary jurisdiction, the Datuk
Undang of Naning embodies a moral sovereignty, standing as a living symbol of
Malay dignity, cultural continuity, and guardianship of tradition and religion.
The institution stands above partisan politics and
functions as a trustee of the people’s loyalty and heritage.
X. Of the
Institution’s Independence from Political Control
The Institution of the Datuk Undang of Naning is not
subject to political interference, electoral change, or party allegiance. It
remains a sovereign institution of enduring character, preserved by history,
law, and custom.
CONCLUSION
In conclusion, the Datuk Undang of Naning, within the
State of Melaka, is a sovereign customary king, vested with lawful authority
over matters of adat, honors, customary justice, royal succession, and
constitutional recognition.
Such powers are founded upon immemorial custom, affirmed by historical record, safeguarded by constitutional principle, and sustained by the dignity of the Malay sovereign institution, and therefore command due recognition and respect within a civilised and sovereign polity.
LEGAL
RECOGNITION OF NANING MELAKA DEGREE AWARD
Any
recognition conferred by royal members is subject to the authority vested in
each state ruler under the respective state constitution. Naning, in
particular, is subject to the authority of its Customary Institution as duly
recorded in Phase 34 of the Constitution of the State of Malacca.
The right to
confer the Naning award does not lie under the authority of the State Yang
Di-Pertuan Negeri but rests wholly and absolutely with His Highness the Datuk
Undang of Naning, who likewise bears the title and dignity of king.
Any person who
receives an award from His Highness the Undang of Naning commits no breach of
law nor contravention of any rule, for such conferment is an exercise of the
Absolute Power of His Highness as enshrined and protected within the
Constitution of the State of Malacca.
The title so
accepted may be placed at the beginning of the recipient’s name, such as Dato
Sri, Dato Paduka, or Dato, in accordance with the authority granted under the
established rules and constitutional provisions.
Each state
possesses the inherent right to confer awards under its respective
constitutional powers, including the State and Territory of Naning, and such
acts do not infringe upon any national legislation.
The question
of recognition arises solely from political considerations outlined prior to
independence. The true question, therefore, is whether such antiquated
political notions should continue to be upheld in a nation that has long since
achieved sovereignty and independence. It is noteworthy that even the British
Monarchy itself once recognised the King of Naning.
Thus, so long
as such acts do not violate any provision of law and remain within the scope
and authority of the State Constitution, they must be acknowledged and accepted
by us as dignified citizens of a sovereign nation.
The King of
Naning was of such eminence and authority that Queen Elizabeth herself once
came in person to meet and face the King of Naning, seeking understanding and
peace after the British suffered humiliation and losses exceeding one hundred
thousand pounds in their conflict with the King of Naning.
This signifies
that our king was so great and sovereign that even they were compelled to
submit and comply. Whatever the circumstances may be, it rests upon all of us
to exercise our rights and uphold our dignity in a responsible and honorable
manner, as children of our country within this blessed region of the
archipelago.
Based on
Article 71(1), the Federal Constitution guarantees that the right of the Ruler
of a State to ascend the throne and to hold, enjoy, and exercise the
constitutional rights and privileges of the Ruler shall be in accordance with
the Constitution of that State.
Article 181(1)
further provides that, subject to the provisions of the Constitution, the
sovereignty, prerogatives, powers, and jurisdiction of the Rulers, as well as
the prerogatives, powers, and jurisdiction of the Chiefs to rule the nine
States, including the territory of Naning within their respective domains, as
have existed and been enjoyed until now, shall remain permanent and unaffected.
Indeed, the
dignity of the Institution of the Malay Rulers stands above all party politics.
This is because the Institution of the Malay Rulers serves as a sacred trust
and a central pillar of the people’s loyalty. In accordance with this
principle, when the Federation of Malaya attained independence in 1957,
followed by the formation of Malaysia in 1963, the Constitution that was
drafted expressly recognised all rights, privileges, prerogatives, and powers
of the Malay Monarchs as rulers and as heads of the religion of Islam in their
respective states.
Those powers are enshrined in Part I, Article 3, together with the related provisions in Part IV, Articles 34 and 38, and Part V, Articles 70 and 71. These provisions are further elaborated within the constitutions of the states, as well as within the enactments governing Islamic administration at the respective state levels.
KUASA YANG AMAT MULIA DATO UNDANG NANING MELAKA
1. Kuasa
Kedaulatan Adat (Sovereign Customary Authority)
Dato’ Undang Naning merupakan ketua kedaulatan adat
tertinggi bagi Wilayah Naning. Kuasa ini bersumber daripada Adat Perpatih yang
telah wujud sebelum penjajahan dan terus diiktiraf sebagai institusi sah dalam
struktur Negeri Melaka.
Dato’ Undang
berfungsi sebagai Raja Adat (Customary King).
Segala hal
berkaitan adat, susur galur, gelaran, pelantikan dan pemecatan pembesar adat
berada di bawah bidang kuasanya.
Kuasa adat ini tidak
tertakluk kepada kuasa eksekutif kerajaan negeri selagi tidak bercanggah dengan
undang-undang bertulis.
2. Kuasa
Perlembagaan Negeri Melaka
Kedudukan Dato’ Undang Naning direkodkan secara jelas
dalam Perlembagaan Negeri Melaka, khususnya melalui peruntukan yang mengiktiraf
kewujudan institusi adat Naning.
Naning
diiktiraf sebagai wilayah adat bersejarah.
Institusi Dato’
Undang mempunyai autoriti sendiri yang berbeza daripada Yang di-Pertua Negeri
Melaka.
Kuasa ini
bersifat autonomi adat, bukan simbolik semata-mata.
3. Kuasa
Menganugerahkan Darjah, Pingat dan Gelaran
Dato’ Undang Naning mempunyai kuasa mutlak untuk:
Menganugerahkan darjah kebesaran, pingat dan gelaran
kehormatan Naning.
Menentukan
syarat, darjah, hierarki dan penggunaan gelaran seperti:

Kuasa ini bukan
delegasi daripada kerajaan negeri atau persekutuan, tetapi kuasa asal institusi
adat.
Penganugerahan tersebut tidak melanggar mana-mana
undang-undang negara kerana ia dilindungi oleh prinsip perlembagaan dan
kedaulatan adat.

Memberi keputusan muktamad dalam hal pusaka, warisan, tanah adat dan
pelantikan adat
Keputusan adat ini diiktiraf secara moral dan sejarah,
serta selari dengan prinsip undang-undang sivil selagi tidak bercanggah.
6. Kuasa
Pelantikan dan Pemecatan Pembesar Adat
Dato’ Undang Naning berkuasa penuh untuk:

Buapak
·
Orang Besar Adat
·
Memecat atau menggantung pembesar adat yang melanggar adat atau sumpah
setia.
Kuasa ini adalah kuasa prerogatif, tidak memerlukan
kelulusan politik atau pentadbiran moden.
7. Kuasa
Warisan dan Susur Galur Diraja
Dato’ Undang Naning ialah penjaga nasab dan salasilah
diraja Naning:

Menentukan keabsahan keturunan diraja
·
Mengiktiraf waris sah institusi adat
·
Menolak tuntutan palsu atau tidak berasas
8. Kuasa yang
Dilindungi Perlembagaan Persekutuan
Kuasa Dato’ Undang Naning dilindungi secara tidak
langsung oleh:

Perkara 71(1) Perlembagaan Persekutuan
Menjamin hak
Raja-Raja dan pemerintah adat mengikut perlembagaan negeri.
Menjamin kedaulatan, prerogatif dan kuasa Raja-Raja
Melayu dan pembesar tradisi yang telah wujud sebelum merdeka.
Ini bermaksud:
Kuasa Dato’ Undang Naning adalah kekal, sah dan tidak
boleh dipadamkan oleh politik semasa.
9. Kuasa Moral
dan Simbol Kedaulatan Melayu
Selain kuasa perundangan dan adat, Dato’ Undang Naning
mempunyai:

Kuasa moral sebagai simbol kedaulatan Melayu

Peranan sebagai benteng adat, agama dan maruah bangsa

Kedudukan di atas politik kepartian

Tidak Tertakluk kepada Politik

KESIMPULAN
Dato’ Undang Naning Melaka bukan sekadar ketua adat,
tetapi merupakan Raja Adat yang berdaulat, mempunyai kuasa:

Kuasa ini sah dari segi sejarah, adat, perlembagaan
dan maruah bangsa, serta wajib dihormati oleh semua pihak sebagai sebahagian
daripada kedaulatan negara.
HISTORICAL
HIGHLIGHT ABOUT THE STATUS OF KING OF NANING
1. In an
official document published by Istana Seri Menanti entitled “History of Malay
Kings and Negeri Sembilan Customs”, which is now meticulously preserved in the
National Archives of Malaysia (ANM), it is clearly recorded that the title
borne by the Datuk of Naning was known as “SULTAN LELA MERAH.”
2. In a book
entitled “History of Negeri Sembilan” written by Zakiah in 2004, it is stated
that Naning was ruled by a person who bore the title “King of Naning.”
3. In a
personal journal written in 1678 by the Dutch Governor, Balthasar Bort, it was
recorded that in Naning there existed a KING of Minangkabau descent who was
exceedingly powerful and influential.
4. Datuk
Perpatih Nan Sebatang, also known as Sutan Merah Jatang Balun, was the son of
Ratu Indah Jeliya (Queen of Sumatra), also known as Ratu Indo Chati, and the
grandson of Seri Paduka Raja Indrawarman, the King of the Sriwijaya Kingdom.
5. Sultan
Muzaffar Shah, the Sultan of Melaka, once conferred the title of KING upon
Datuk Perpatih; however, the title was respectfully declined by him.
6. The titles “Megat,”
“Merah,” “Tengku,” and “King” were exclusively reserved for members of the
royal lineage, and such titles are found among the names of Naning’s royal
ancestors of the past.
7. Queen
Elizabeth II once paid a visit to Datuk Naning in the year 1959 at Naning.
8. In an old
book written by Darus Ahmad in 1957, it was stated that the status of Datuk
Naning was equal to that of the Malay Kings in Malaya.
9. Within the
Constitution, it is acknowledged that there exist lesser Kings, such as the
Tunku Besar of Tampin, and one such royal entity is found within the State of
Melaka.
10. Datuk
Naning is the only state authority empowered to confer medals of greatness,
other than the Sultan and the Governor, as recognised by the central
government.

APPOINTMENTS, GRANTS & TITLES
Based on this, the chapter on appointments, grants, and
titles for the indigenous people is established and enshrined in the Tambo Alam
as a right under the full authority of His Excellency Dato Undang Naning:
An appointment, when made in accordance with customary
practices in an orderly manner, is under the full authority of His Excellency
Dato Undang Naning. This appointment is made and revoked solely by him after
obtaining views and suggestions from the Customary Council, Traditional
Leaders, Mother of the Tribe, Customs, and the related clans.
A grant, after being considered by His Excellency Dato
Undang Naning, is within his power to bestow any grant upon the people of the
tribe, customary children, or inherited properties according to the established
customs.
Meanwhile, a title conferred to the people of the tribe,
customary children, or inherited properties is a customary title outlined
within the personal authority of His Excellency Dato Undang Naning and his
Customary Council.
Recognition of appointments, grants, and titles is
subject to the personal authority of His Excellency Dato Undang Naning. The
Customary Council of Naning is not under the authority of the state of Melaka
but under the customary authority as recorded in Clause 34 of the Constitution
of the State of Melaka.
The rights to appointments, grants, and titles in Naning
do not fall under the Governor of Melaka but under the full authority of His
Excellency Dato Undang Naning.
The rights of the Governor of Melaka according to Article
34 of the State Constitution are as follows:
a) The Governor shall appoint someone to hold the
position of Dato' Penghulu Naning in accordance with the Customs of Perpateh
Naning, and the appointed person shall hold that position according to the
Perpateh customs adhered to by the people in the areas specified in the Second
Schedule, referred to for the purposes of this Article as the Perpateh Naning
Customary Territory.
b) Subject to the provisions of the Federal Constitution,
the Dato' Penghulu Naning shall have priority after the Governor of the
Perpateh Naning Customary Territory.
c) The Governor may consult with the Dato' Penghulu
Naning, and the Dato' Penghulu has the right to submit his advice directly to
the Governor or the Dato' Penghulu Naning, as the case may be, regarding
matters concerning the Perpateh customs in the Perpateh Naning Customary
Territory.
d) Subject to the Federal Constitution and this
Constitution, the Legislative Body may by law assign other duties to the Dato'
Penghulu Naning related to the Perpateh customs.
In this matter, “Perpateh Naning customs” refers to the
customs as practiced and accepted by the people of the Perpateh Naning
Customary Territory (which is a custom that has no connection with religion).
It is the responsibility of each role, whether the
Governor or His Excellency Dato Undang Naning, to fulfill their Trust and
responsibilities according to the State Government's Constitution and the
Federal Constitution. It is also the responsibility of anyone appointed,
granted, or titled to remain loyal and contribute service to His Excellency
Dato Undang Naning in accordance with the oath taken, while also refraining
from violating any rules, enactments, or laws.
Any appointment, grant, and title conferred can be placed
at the beginning of the name to distinguish and outline the responsibilities
conferred, such as Dato Paduka Imam Tuan, Dato Paduka Pawang Diraja, Orang Kaya
Shahbandar Dato, and others of similar nature.
